When prospective clients come in to ask me whether they can have a mediated divorce even if they don’t get along, I explain to them that, yes, they can have a mediated divorce. The reason that it’s possible is that it is the mediator’s job to bring the people together and have them reach an accommodation. They may not get along, but they also may not know how to communicate. It’s my job, as the mediator, to get them to talk about it, understand, discuss the realities, and wind up with what they need. If one party is being completely unreasonable and it’s not just a question of them not getting along, then it may be that mediation is not the process for them.
