One of the questions I’m frequently asked about mediation is whether the mediator will meet with the clients together or separately. In my practice and the way that I was taught mediation, I can only meet with both parties together. I can never meet with either party individually unless it’s requested and the other party agrees to it. For the most part, I see both parties together and don’t correspond or speak with one party without the other being on the line or without getting a copy of whatever correspondence is involved.
