Yes, it can be settled. However, a litigated divorce takes much longer to be settled. Once your divorce is in the court system, which means by its name it is now in litigation, you have to, at that point in time, follow the rules of the court, the dates of the court, have meetings when the judge decides, and you have given up part of your control to the court system. Because of that, these cases take longer to settle and they are generally more expensive. During that time, your lawyer must zealously represent you, which means your lawyer has to fight for your rights. Every time there’s a fight, there’s a winner and a loser. That’s one of the reasons why I suggest to my clients that they use collaborative divorce or mediation.
